Agreement to Terms
By downloading, installing, or using the DayTap app ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
Service Description
DayTap is a daily check-in safety monitoring app designed for people who live alone. The Service allows you to:
- Check in daily by tapping "I'm OK" in the app.
- Designate emergency contacts ("guardians") who will be notified if you miss your check-in window.
- Set a custom check-in threshold (24, 48, or 72 hours).
- Receive reminder notifications before your check-in window expires.
Subscription Terms
DayTap offers a subscription service with the following terms:
- Price: $0.99 USD per month.
- Billing: Subscriptions are billed monthly through Apple's App Store.
- Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
- Cancellation: You may cancel your subscription at any time through your Apple ID settings. Cancellation takes effect at the end of the current billing period.
- Free Trial: If offered, free trial periods convert to paid subscriptions unless cancelled before the trial ends.
Guardian alert notifications (email and SMS) require an active subscription. Push notification reminders work regardless of subscription status.
Your Responsibilities
By using DayTap, you agree to:
- Provide accurate contact information for yourself and your guardians.
- Obtain consent from your guardians before adding their contact information.
- Use the Service only for its intended purpose of personal safety monitoring.
- Not use the Service for any illegal or unauthorized purpose.
- Maintain the security of your Apple ID and device.
Important Limitations
DayTap is not a replacement for emergency services. The Service is designed as a supplementary safety tool and has the following limitations:
- DayTap does not contact emergency services (911, police, fire, or ambulance).
- Notification delivery depends on internet connectivity, email servers, and mobile networks, which may experience delays or failures.
- The Service cannot detect emergencies—it only monitors whether you have checked in.
- In case of a genuine emergency, always contact emergency services directly.
Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:
- The Service will be uninterrupted, timely, secure, or error-free.
- Notifications will be delivered successfully in all circumstances.
- The Service will meet your specific requirements or expectations.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAYTAP AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of life, personal injury, or property damage.
- Failure or delay in notification delivery.
- Service interruptions or outages.
- Unauthorized access to your account.
Our total liability for any claim arising from or related to these Terms or the Service shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.
Account Termination
We reserve the right to suspend or terminate your account if you:
- Violate these Terms of Service.
- Use the Service for fraudulent or illegal purposes.
- Abuse the notification system (e.g., adding guardians without consent).
You may delete your account at any time through the app settings. Upon deletion, all your data will be permanently removed.
Changes to Terms
We may modify these Terms at any time. We will notify you of significant changes by updating the "Last updated" date and, where appropriate, through in-app notifications. Continued use of the Service after changes constitutes acceptance of the new Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
